AI Mail: AI Email Writer – Terms of Use

Introduction
These Terms of Use (the “Terms”, “Agreement” or “EULA”) form a legally binding agreement between you and 3B Studio (“3B Studio”, “we”, “us”, or “our”) governing your access to and use of AI Mail: AI Email Writer, including our mobile applications, web application, browser extensions, and any associated documentation, websites, and services (collectively, the “Services”). By downloading, installing, accessing, or using the Services, you: (a) acknowledge that you have read and understood these Terms; (b) agree to be bound by these Terms; and (c) represent that you have the legal capacity and authority to enter into this Agreement. If you do not agree with these Terms, you must not use the Services.
Privacy Policy and Supplemental Terms
These Terms incorporate by reference our Privacy Policy, as well as any additional terms presented to you at the time of purchase, download, or signup (collectively, the “Supplemental Terms”). In the event of any conflict between these Terms and any Supplemental Terms, the Supplemental Terms will govern for the specific Service or feature. If you obtained the app through a third-party platform (such as the Apple App Store or Google Play Store), your use of the app may also be subject to that platform’s terms and conditions. To the extent there is any conflict, these Terms govern the relationship between you and 3B Studio, and the platform’s terms apply between you and the platform provider.
1. Eligibility and Age Requirements
You may use the Services only if you are legally capable of entering into a binding contract with us and not barred from doing so under applicable law. You must be at least 13 years old to use the Services, or at least 16 years old if you are located in the European Economic Area (EEA) or where applicable law requires a higher minimum age. If you are between 13 (or 16 in the EEA) and 18 years old, you may use the Services only under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. Notice to parents and guardians: If you permit your child to use the Services, you agree to these Terms on their behalf and are responsible for supervising their use. 2. License Grant
Subject to your compliance with these Terms, 3B Studio grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to: (a) download, install, and use our mobile app on a device you own or control; and (b) access and use our web app and related online Services; solely for your personal, lawful, and non-commercial use, in accordance with these Terms and applicable law. We reserve all rights in and to the Services not expressly granted to you under these Terms.
3. Acceptable Use and Restrictions
You agree that you will not, and will not permit any third party to: copy, modify, adapt, translate, or create derivative works based on the Services (except as expressly permitted by us); reverse-engineer, decompile, disassemble, or attempt to derive source code or underlying ideas (except where prohibited by law); sell, rent, lease, sublicense, distribute, or transfer the Services or license rights; use the Services for any unlawful, harmful, fraudulent, infringing, defamatory, or objectionable purpose; generate or facilitate spam, phishing, or unauthorized communications; use automated means (bots, crawlers, scrapers) to access the Services unless permitted in writing; bypass or interfere with security-related features; or misrepresent your identity or impersonate any person or entity. You are responsible for your conduct and for any content you submit, generate, or send using the Services.
4. Account Registration and Security
Some features may require you to create an account or sign in via a third-party login provider (such as Google or Apple). You agree to provide accurate, current, and complete information during registration and keep it up to date. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately at aimail@3bproductai.com of any unauthorized use of your account or breach of security. 3B Studio is not liable for any loss or damage arising from your failure to protect your credentials or comply with these obligations.
5. Subscriptions, Trials, Billing, and Cancellation
5.1 Free and Paid Plans: The Services may be offered on a free or paid basis, including subscription tiers (e.g., free, Pro, or other premium plans). Details about pricing, features, and plan duration are provided within the app or on the purchase page. 5.2 Billing and App Store Purchases: If you purchase through Apple App Store or Google Play Store, billing and cancellation are governed by that platform’s terms and policies; 3B Studio does not control refunds, billing, or account settings on those platforms. If you purchase directly from us, you authorize us (or our payment processor) to charge the applicable fees and taxes on a recurring basis unless you cancel. 5.3 Free Trials: We may offer free trials; unless stated otherwise, trials convert automatically to paid subscriptions at the end of the trial period and you will be charged unless you cancel before the trial ends. 5.4 Automatic Renewal: Unless canceled, subscriptions renew automatically at the end of each billing period at the then-current price; we may change prices and will provide notice of material changes as required by law. 5.5 Cancellation and Refunds: To cancel a store purchase, use that store’s subscription settings; uninstalling the app does not cancel. For direct purchases, cancel via the billing settings we provide or contact support. Unless required by law or explicitly stated by us, payments are non-refundable and there are no credits for partial periods.
6. Service Functionality and AI-Generated Content
AI Mail: AI Email Writer provides tools to draft, rewrite, summarize, and improve email content using artificial intelligence. Features may vary by app version, subscription plan, and device. AI-generated content is produced automatically based on your input and system behavior. While we aim to provide helpful suggestions, you understand and agree that: (a) AI outputs may be inaccurate, incomplete, inappropriate, or not suited to your context; (b) you are solely responsible for reviewing, editing, and approving any content before using it; and (c) you remain responsible for complying with all applicable laws, rules, and policies (including email, privacy, and anti-spam laws). We do not guarantee the Services will be uninterrupted, error-free, or secure. We may modify, suspend, or discontinue any aspect of the Services at any time, with or without notice, subject to applicable law.
7. Third-Party Services and OpenAI
The Services may integrate with third-party services, APIs, software, and content providers, including cloud infrastructure, analytics providers, and AI model providers such as OpenAI. Your use of third-party services may be subject to separate terms and privacy policies from those parties. We do not control and are not responsible for third-party services or content, including availability, accuracy, or security. In particular, the Services may use the OpenAI API to generate or transform content based on your input. By using these features, you agree to comply with any applicable OpenAI use policies when sharing or publishing AI-generated content, including rules regarding prohibited content and proper attribution, as applicable.
8. Intellectual Property
The Services (including software, code, design, text, graphics, logos, icons, images, audio, video, and other materials) and all associated intellectual property rights are owned by 3B Studio or our licensors and are protected by copyright, trademark, and other laws. Except as expressly permitted by these Terms, you may not use our trademarks or brand elements without prior written consent, and you may not remove or alter proprietary notices. Nothing in these Terms grants you ownership rights in the Services.
9. User Content and License
You may provide content to the Services, including email text, prompts, feedback, and other materials (“User Content”). You retain ownership of your User Content, subject to the rights you grant us. By submitting User Content, you grant 3B Studio a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, process, and store your User Content as necessary to provide, maintain, secure, and improve the Services, and to display/transmit your User Content as directed by you (for example, in the app UI or in your account). We handle User Content in accordance with our Privacy Policy. You represent and warrant you have all necessary rights to submit User Content and that it does not violate third-party rights or applicable laws.
10. Feedback
If you provide suggestions, ideas, or feedback (“Feedback”), you agree that 3B Studio may use such Feedback for any purpose (including improving or marketing the Services) without compensation, acknowledgment, or restriction. You hereby assign to 3B Studio all rights, title, and interest in and to any Feedback you provide.
11. Privacy
Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection and processing of your information as described in the Privacy Policy.
12. Suspension and Termination
We may, at our discretion and to the extent permitted by applicable law, suspend or terminate your access to the Services (including your account and license) at any time, with or without notice, if: you violate these Terms or applicable law; we suspect fraudulent, abusive, or harmful activity; or we decide to discontinue the Services or a feature. Upon termination, your right to use the Services will cease immediately and you must stop using the Services and uninstall the app from your devices. Provisions that by their nature should survive termination (including ownership, warranty disclaimers, limitation of liability, and indemnity) will continue to apply.
13. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided on an “AS IS” and “AS AVAILABLE” basis, and your use is at your sole risk. 3B Studio and its affiliates, licensors, and service providers disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will meet your requirements, be uninterrupted, timely, secure, or error-free; that defects will be corrected; or that any content (including AI-generated content) will be accurate, reliable, or complete. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
14. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall 3B Studio, its affiliates, directors, employees, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or in connection with: your access to or use of (or inability to use) the Services; any third-party conduct or content; any content obtained from the Services (including AI-generated content); or unauthorized access, use, or alteration of your data. In no event shall 3B Studio’s total liability exceed the amount you paid (if any) for the Services in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow certain liability limitations, so some limitations may not apply to you.
15. Indemnification
You agree to indemnify, defend, and hold harmless 3B Studio and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: your use of the Services; your violation of these Terms; your violation of any rights of another person or entity; or your User Content or AI-generated content used, shared, or sent by you.
16. Governing Law and Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them or the Services shall be governed by and construed in accordance with the laws of [Insert Governing Law Country/Region], without regard to its conflict-of-law principles. Where permitted by law, you and 3B Studio agree to first attempt to resolve disputes amicably. If no resolution is reached, disputes shall be resolved in the courts of [Insert City/Country], and you consent to the exclusive jurisdiction and venue of such courts. You agree to bring claims only on an individual basis and not as a plaintiff or class member in any purported class or representative action, where such a waiver is permitted by law.
17. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last Revised” date at the top and may provide additional notice (for example, in-app notification or email), as required by law. By continuing to use the Services after the updated Terms become effective, you agree to be bound by the revised Terms. If you do not agree to the changes, you must stop using the Services.
18. Miscellaneous
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be deemed a waiver. You may not assign or transfer these Terms or your rights/obligations without our prior written consent. We may assign or transfer these Terms without restriction.
